1. Many goods which Reclaim sells are not new but are second-hand, having often been (we trust lovingly) used over the years. Any guarantees or warranties relating to such goods are amended accordingly and, generally, such items are sold “as is” and with all faults (if any). Please therefore carefully examine all second-hand goods prior to purchasing them. Generally speaking, however, the “patina” of such goods, in our opinion, enhances their uniqueness, value and attraction.
2. Goods sold by Reclaim are otherwise subject to the provisions of the Australian Consumer Law (and other relevant legislation) in relation to consumer guarantees. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Save in respect of those provisions implied by law which cannot be avoided or amended, Reclaim’s liability for faulty goods (excluding reasonable wear and tear or neglect by you) is limited, at our option, to the replacement of those goods or to the reimbursement of their purchase price (upon reasonable evidence by way of original tax invoice or the like). Other than as referred to above, Reclaim is not under any obligation to refund the purchase price, to supply a “Reclaim” credit note or otherwise, in the event that you simply change your mind after purchase (or no longer want the goods). In those circumstances, however, Reclaim may, in its sole discretion, offer you a “Reclaim” credit note upon the return of the goods in their original condition and packaging. Any credit note may require the amount concerned to be spent at “Reclaim” within a set period.
